Terms of Service

Hello is a friendly daily call from an AI companion, not a medical or emergency service. You pay through the App Store and can cancel anytime. Only set Hello up for someone who has agreed to it.
These Terms of Service (“Terms”) are an agreement between you and Illuminant Inc, a California corporation (“Illuminant”, “we”, “us”). They cover Hello: the daily calls, the Hello family app, the Hello Parent app, and hello.illuminantinc.com (together, “Hello”). By creating an account, joining a family circle or using Hello, you agree to these Terms, our Privacy Policy and our Consent and recording policy.
1. What Hello is, and what it isn’t
Hello is a subscription service. An AI companion places a friendly phone call to a person you care about (“your parent”) at a time you choose, passes along reminders you set, and sends your family summaries and alerts.
Hello is not a medical service, a monitoring or medical alert device, or an emergency service.
- Hello does not diagnose, treat or give medical, legal or financial advice.
- Hello cannot and does not contact 911 or any emergency service. In an emergency, your parent should call 911 directly.
- Hello depends on phone networks, internet services and AI models that can fail or make mistakes. A call may not go through, an alert may be delayed, or a summary may mishear or leave something out.
- Hello does not replace your own contact with your parent, their caregivers or their doctors.
Do not rely on Hello as the only way to know that your parent is safe.
2. Who can use Hello
- You must be at least 18 and able to form a binding contract.
- Hello is offered in the United States, for calls to US phone numbers.
- You sign in with Apple. You’re responsible for keeping your Apple account and devices secure and for what happens under your account.
- The information you give us, including your parent’s name and phone number, must be accurate and yours to share.
3. Your parent’s consent
Hello only works with the agreement of the person it calls. By setting up Hello for someone, you promise that:
- you have talked with them and they are happy to receive Hello’s calls;
- the phone number belongs to them and you are allowed to give it to us;
- you will stop the calls if they tell you they no longer want them;
- anyone you add as an emergency contact has agreed to be contacted by Hello.
Hello also asks your parent for their consent on the first call and won’t call again if they say no. Either of you can stop the calls at any time, as described in the Consent and recording policy. Setting up Hello to call someone without their agreement, or to monitor someone against their wishes, is not allowed.
4. Family circles
A family circle is the group of people who share Hello for a parent.
- The owner subscribes and is responsible for the circle. The owner and any admins can invite people, choose who can read full transcripts, set the alert plan and manage the parent’s profile.
- Joining a circle is free.
- Members may see summaries, alerts and, if allowed, transcripts about the parent. Use that information only to care for your parent, and keep it private.
- If someone in the circle misuses Hello, the owner or an admin can remove them.
- We may act on reports of abuse, including suspected abuse of an older adult, as described in section 9.
5. Subscriptions, trials and billing
- Paying through Apple. Subscriptions and gifts are sold through Apple’s App Store and billed to your Apple account. Apple’s terms and payment policies also apply. We never see your payment card.
- Plans. Current plans and prices are shown in the app and on our home page.
- Each plan covers one parent with one scheduled call a day of up to 15 minutes.
- Calls your parent makes to Hello are included, up to 60 minutes a day under fair use.
- Add-ons cover a second parent or a second daily call.
- Prices may vary by region and may include taxes.
- Free trial. New subscribers may get a free trial, as offered in the App Store. Calls run during the trial. Unless you cancel at least 24 hours before the trial ends, your subscription starts and you’re charged.
- Automatic renewal. Subscriptions renew automatically at the end of each period at the then-current price, unless you cancel at least 24 hours before the period ends. Cancel in your iPhone’s Settings › [your name] › Subscriptions, or from Settings › Subscription in the Hello app. Service continues until the end of the period you’ve paid for.
- Refunds. Apple handles all refunds under its policies (reportaproblem.apple.com). When Apple refunds a purchase, the service it paid for ends.
- Price changes. We’ll give you notice through Apple before a price increase applies to you, and Apple will ask for your consent where required.
- Your family circle, not your Apple ID. A subscription covers the family circle it was bought for. Family members using Apple Family Sharing may install the app without paying again, but a Family Sharing purchase does not activate a circle by itself.
- Billing problems. If a renewal payment fails, Hello keeps calling for a short grace period while Apple retries. After that, scheduled calls pause until the subscription is active again.
6. Gifts
- A Hello gift is a one-time purchase of a year of service, delivered as a gift code.
- The code can be redeemed in the Hello app within a year of purchase. The year of service starts on the day it is redeemed and does not renew; nobody is charged when it ends.
- The person who buys a gift does not receive the service and is not subscribed.
- Gift codes have no cash value and can’t be resold.
- Keep your code safe: anyone who has it can redeem it.
- If Apple refunds a gift purchase, the code stops working, and if it was already redeemed, the gifted service ends.
7. Acceptable use
Don’t use Hello to:
- call anyone who hasn’t agreed, or anyone who has asked not to be called;
- harass, deceive, frighten, exploit or monitor a person against their wishes;
- impersonate someone, or ask Hello to pass messages that pretend to come from someone else;
- try to get Hello to produce harmful, illegal or sexual content, or to give medical, legal or financial instructions;
- make marketing, sales or robocalls of any kind;
- access another family’s information, probe or disrupt our systems, reverse-engineer the apps beyond what the law allows, or use automated tools to access Hello;
- break any law, including telemarketing, privacy and recording laws.
8. Your content
“Your content” is what you and your parent give Hello: profile details, reminders, messages and photos you add, and what is said on calls.
- You keep all rights in your content.
- You give Illuminant a limited licence to store, process, transmit and display it only to provide Hello to your family and to keep it working safely, including through the service providers listed in our Privacy Policy.
- We don’t sell your content, don’t use it for advertising, and don’t let AI providers train on it.
- If you send us feedback or ideas, we may use them without owing you anything.
Hello’s software, voice persona, design and name belong to Illuminant and its licensors. Subject to these Terms, we give you a personal, non-transferable licence to use the Hello apps on Apple devices you own or control.
9. Safety, suspension and ending your account
- You can stop at any time. Cancel your subscription, and delete your parent’s profile, your family circle or your account in the app (see Privacy Policy).
- We may suspend or end access if you break these Terms, if we’re required to by law, or to protect your parent, other people or Hello. Where it’s safe and lawful, we’ll tell you why and give you a chance to fix the problem.
- Suspected abuse. If we believe an older adult is being harmed, we may stop calls, limit a family member’s access, keep relevant records and point the person to Adult Protective Services or law enforcement.
- If we end Hello as a whole, we will give at least 30 days’ notice where we can. You can export your data during that time. Any refunds are handled through Apple.
Sections 1, 8 (the feedback and ownership parts), 10, 11 and 12 continue to apply after your account ends.
10. Disclaimers
Hello is provided “as is” and “as available”. To the fullest extent the law allows, Illuminant disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. In particular, we don’t promise that:
- calls will always connect or happen at the exact scheduled time;
- Hello will notice every concern or never raise a false alarm;
- summaries will be complete or accurate;
- notifications or texts will arrive on time.
Some states don’t allow these disclaimers, so parts of this section may not apply to you.
11. Limitation of liability
To the fullest extent the law allows:
- Illuminant is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from Hello.
- This includes anything that happens because a call didn’t connect, an alert was missed or delayed, or a summary was wrong.
- Our total liability for all claims about Hello is limited to the greater of (a) the amount you paid for Hello in the 12 months before the claim, and (b) US $100.
These limits don’t apply to liability that can’t be limited by law, such as for gross negligence, fraud or wilful misconduct.
12. Disputes and governing law
- California law. These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.
- Talk to us first. If you have a problem, write to us at support@illuminantinc.com first and give us 30 days to try to resolve it.
- Courts. If we can’t resolve it, either of us may bring a claim in the state or federal courts located in Orange County, California, and we both consent to their jurisdiction.
- Small claims. Either of us may use small claims court instead, if the claim qualifies.
- Your consumer rights are unaffected. Nothing here limits rights you have under the consumer protection laws of the state where you live.
13. Apple
The Hello apps are distributed through Apple’s App Store, so these terms also apply between you and us:
- These Terms are between you and Illuminant only, not Apple. Illuminant, not Apple, is responsible for the apps and their content.
- Apple has no obligation to provide maintenance or support for the apps.
- If an app fails to meet an applicable warranty, you may notify Apple, and Apple will refund the app’s purchase price, if any. Apple has no other warranty obligation for the apps.
- Illuminant, not Apple, is responsible for any claims about the apps, including product liability, legal or regulatory compliance, consumer protection and privacy claims, and any claim that an app infringes someone’s intellectual property.
- You confirm that you are not in a country subject to a US government embargo and are not on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- You must also follow the terms of any third-party service you use with the apps, such as your phone carrier.
14. Changes to these Terms
We may update these Terms as Hello changes. For meaningful changes we’ll tell account holders in the app at least 30 days before they take effect, unless a change is needed sooner for legal or safety reasons. If you keep using Hello after the changes take effect, you accept them. If you don’t agree, you can cancel and delete your account.
15. General
- These Terms, together with the policies they mention, are the whole agreement between you and us about Hello.
- If a court finds part of them unenforceable, the rest still applies.
- If we don’t enforce a term right away, we haven’t given up the right to enforce it later.
- You may not transfer these Terms to someone else. We may transfer them as part of a merger, acquisition or sale of assets, with notice to you.
- Neither of us is responsible for delays caused by events beyond reasonable control, such as network or power failures.
